  • What the marital property includes – This should be a detailed list of the applicable property acquired in the course of the marriage.
  • What the marital property does not include – In other words, what will remain separate property and will not need to be included in the terms of the divorce.
  • Details associated with the sale of any marital property – When this applies, the amount of money obtained from the sale of the property should be included.
  • How the marital debt will be divided – Although debt is not an issue in every divorce, when it is something that needs to be covered by marital settlement agreements, both individuals in the divorce will need to be aware of the fact that creditors can still go after both of them regardless of what they end up agreeing to in marital settlement agreements.

Terms Regarding Child Custody

When a child is (or children are) involved in the divorce, the terms of marital settlement agreements pertaining to child custody should specifically include information regarding:

  • Whether either parent will have sole legal custody of the child
  • Whether either parent will have sole physical custody of a child
  • Whether parents will share joint custody or some other custody split has been agreed upon
  • What steps either parent must take before removing the child from the county, state and/or country
  • Whether the child’s last name may be changed (when applicable).
