Although any number of different factors can contribute to truck accidents, trucker negligence is one of the most common causes of these collisions. In fact, some researchers have found that truck driver negligence is a factor in as many as 90 percent of all truck accidents that occur each year in the U.S. While this fact alone is disturbing, what can be possibly even more unsettling is knowing that so many accidents may have been prevented (or may have been far less serious) if truck drivers were far less negligent and reckless when they were operating commercial vehicles.

1. Truck Driver Intoxication: Drunk Driving

Even though drinking and driving is against the law, many people – including commercial truck drivers – still make the reckless choice to engage in this dangerous behavior. For truckers, however, the legal limits for intoxication are far lower than they are for passenger drivers, as a BAC of 0.04 is sufficient for a trucker driver to be considered to be legally drunk in the eyes of the law.

What this means is that even just one beer before driving could result in:

  • Truckers being over the legal limits
  • These drivers putting others on the road in serious danger
  • A far greater risk of truck accidents
  • Drunk or intoxicated truck drivers being held liable if or when they cause accidents to others on the road.

2. Truck Driver Fatigue

This is, unfortunately, a significant problem that causes a number of accidents, injuries and deaths each year in the U.S. Despite the fact that federal regulators (like, for instance, the Federal Motor Carrier Safety Administration, FMCSA) have instituted rules to try to curb this form of truck driver negligence:

  • Truck drivers and their employers regularly flout these rules.
  • As many as 25 percent of all truckers were reportedly so fatigued while driving within the last 30 days that they had trouble not falling asleep behind the wheel.
  • Truck driver fatigue-related accidents continue to occur.
